Terms of Service

Rules for using the Kitsap Gaming directory, accounts, listings, reviews, forms, and editorial content.

Effective and last updated: August 30, 2026. These Terms of Service (“Terms”) govern your access to and use of kitsapgaming.com and its directory, accounts, listings, reviews, forms, articles, and related features (collectively, the “Service”).

1. Acceptance of these Terms

By accessing or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service. If you use the Service for an organization, you represent that you have authority to bind that organization, and “you” includes both you and the organization.

2. Eligibility

You must be at least 13 years old to create an account, submit a listing or review, or use an interactive form. If you are under the age of legal majority where you live, you may use interactive features only with permission and supervision from a parent or legal guardian who agrees to these Terms. The Service is not directed to children under 13.

3. What the Service provides

Kitsap Gaming is an independent local directory and editorial publication. It helps people discover gaming-related stores, venues, organizations, groups, programs, events, and informational resources. The Service is not an official representative of a listed organization and does not operate, control, certify, or guarantee third-party businesses, events, products, communities, or services.

4. Directory and editorial information

Listings and articles are starting points, not endorsements or guarantees. Hours, schedules, inventory, prices, fees, age rules, accessibility, event formats, capacity, addresses, ownership, and other details can change. You are responsible for confirming decision-critical information with the current primary source before traveling, purchasing, registering, trading, or participating.

Relationship labels such as editorial, organization-managed, or sponsored describe the source or commercial relationship of a listing. Payment cannot purchase praise, factual control, or a guaranteed ranking. We may correct, update, relabel, decline, unpublish, or remove content in accordance with our editorial standards.

5. Accounts and account security

You must provide accurate current information, protect your login credentials, and promptly notify us of suspected unauthorized access. You are responsible for activity conducted through your account unless prohibited by law. We may require verification before allowing a person to claim, manage, or materially change an organization’s listing.

6. Submissions and user content

“User Content” includes listings, descriptions, images, logos, reviews, ratings, corrections, event tips, links, profile information, and other material you submit. You retain ownership of rights you hold in your User Content.

By submitting User Content, you grant Kitsap Gaming a nonexclusive, worldwide, royalty-free, transferable and sublicensable license to host, store, reproduce, format, adapt, publish, display, distribute, and use that content as reasonably necessary to operate, secure, promote, archive, and improve the Service. This license ends when the content is deleted from active publication, except for reasonable backup, legal, security, and archival retention and material already shared outside our control.

You represent that you have the rights and permissions necessary to submit the User Content and that it is accurate to the best of your knowledge. Do not submit confidential information, private personal data, passwords, payment-card data, government identifiers, sensitive health information, or material you are not authorized to share.

7. Reviews, corrections, and community contributions

Reviews should reflect genuine first-hand experience and disclose a material relationship that could affect credibility. Do not submit fake reviews, undisclosed paid endorsements, coordinated rating manipulation, impersonation, retaliation, defamatory accusations presented without a reasonable basis, or private information about another person.

Community tips may identify leads but do not automatically establish a fact. We may request a current primary source, edit for clarity or safety, decline publication, or remove material that cannot be responsibly verified.

8. Prohibited conduct

You may not use the Service to:

  • violate law or another person’s rights;
  • impersonate a person or organization or falsely claim authority over a listing;
  • publish deceptive, fraudulent, harassing, threatening, hateful, exploitative, obscene, defamatory, or unlawfully discriminatory material;
  • submit malware, harmful code, credential-harvesting material, spam, scraping attacks, or automated traffic that burdens or disrupts the Service;
  • circumvent access controls, probe for vulnerabilities without authorization, or interfere with accounts, forms, moderation, ratings, or security systems;
  • collect or expose another person’s private information without lawful authority;
  • use unrelated, low-value, sponsored, or mass-generated content to manipulate search rankings, citations, links, or reputation;
  • misrepresent schedules, inventory, prices, age restrictions, accessibility, credentials, affiliations, endorsements, or commercial relationships; or
  • copy, republish, sell, or exploit substantial portions of the Service except as permitted by law or written authorization.

9. Intellectual property

The Service’s original design, branding, software, selection, organization, and editorial content are owned by Kitsap Gaming or its licensors and are protected by applicable intellectual-property laws. Names, logos, game titles, and trademarks belonging to listed organizations or publishers remain the property of their respective owners. Their appearance does not imply sponsorship or endorsement.

If you believe material on the Service infringes your rights, use the Contact & Corrections page and identify the work, the affected URL, your authority, and a reliable way to contact you.

10. Third-party websites, services, and transactions

The Service may link to third-party websites, maps, social networks, ticketing systems, stores, communities, and payment or registration services. We do not control them and are not responsible for their content, availability, security, policies, products, transactions, disputes, or conduct. Your dealings with a third party are between you and that third party.

11. No professional or emergency advice

Content is provided for general local information. It is not legal, medical, financial, safety, accessibility, or other professional advice. The Service is not an emergency channel. Contact the appropriate venue, organizer, professional, or emergency service for current guidance.

12. Service changes and availability

We may change, suspend, restrict, or discontinue any part of the Service, including accounts, listings, categories, features, or submission options. We do not guarantee uninterrupted operation, permanent storage, search-engine visibility, publication, placement, traffic, leads, attendance, sales, or any particular result.

13. Disclaimer of warranties

To the fullest extent permitted by law, the Service is provided “as is” and “as available.” Kitsap Gaming disclaims express and implied warranties, including warranties of accuracy, availability, merchantability, fitness for a particular purpose, title, noninfringement, and that the Service will be secure or error-free. Some jurisdictions do not allow certain disclaimers, so parts of this section may not apply to you.

14. Limitation of liability

To the fullest extent permitted by law, Kitsap Gaming and its owners, operators, contributors, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost data, business interruption, personal disputes, or losses arising from third-party content, events, products, services, or conduct.

To the fullest extent permitted by law, the total liability arising out of or relating to the Service will not exceed the greater of the amount you paid directly to Kitsap Gaming for the Service during the twelve months before the event giving rise to the claim or US $100. These limitations do not exclude liability that cannot lawfully be limited.

15. Indemnity

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Kitsap Gaming and its owners, operators, contributors, contractors, and service providers from claims, liabilities, damages, losses, and reasonable costs arising from your User Content, your misuse of the Service, your violation of these Terms, or your infringement of another person’s rights.

16. Moderation, suspension, and termination

We may review content and may reject, edit, restrict, suspend, or remove content or accounts when we reasonably believe these Terms, editorial standards, law, safety, or the integrity of the Service require it. You may stop using the Service at any time and may request account deletion through the Contact & Corrections page. Provisions that by their nature should survive termination will survive.

17. Governing law and disputes

These Terms are governed by the laws of the State of Washington, without regard to conflict-of-law rules. Unless applicable law requires otherwise, a legal action arising from these Terms or the Service must be brought in a state or federal court serving Kitsap County, Washington, and the parties consent to that court’s jurisdiction and venue.

18. Changes to these Terms

We may update these Terms when the Service or legal requirements change. The updated effective date will appear at the top. Continued use after updated Terms take effect constitutes acceptance to the extent permitted by law. If you do not agree to an update, stop using the Service.

19. General terms

These Terms and the Privacy Policy are the entire agreement between you and Kitsap Gaming regarding the Service unless a separate written agreement applies. If a provision is unenforceable, it will be limited or removed to the minimum extent necessary and the remaining provisions will continue. Failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent; we may assign them as part of a reorganization or transfer of the Service.
